A tax evasion case for Sh2.5 billion against businesswoman Mary Wamboi and her daughter Purity Mungai has been withdrawn.
Anti-corruption magistrate Felix Kombo withdrew all charges against the two directors of Purma holdings after the DPP informed the court that the Kenya Revenue Authority had reached an agreement with the accused persons.
Lawyer representing the two businesswomen, Nelson Havi and Adrian Kamotho, did not object to the withdrawal application charges under section 204.
"We are in agreement with the decision given that this is a matter that should not have reached the stage of prosecution. It’s anguish she has had to endure a lot of difficulties including denial of certain rights,” said Lawyer Kamotho.
The court was informed that the case had affected Wamboi and her daughter and that the outcome is appreciated.
Purma holdings limited and its directors were charged in the case of illegally omitting Sh2.5 billion from the company's income tax reports.
The two were charged with eight charges of tax evasion under the Tax Procedure Act,2015.
The complainant in the case was the Kenya Revenue Authority.
In a letter dated 21 December, the DPP was requested to withdraw all charges against the accused persons.
"Following the successful compounding of offenses on December 6, 2022, and subsequent payment of fines imposed, the authority now requests to drop the matter pending before the court," the letter stated.
