Former Nairobi Governor Mike Sonko's appeal against the ruling by the Supreme Court of Kenya on his impeachment is set for March 27, 2023, at the East African Court of Justice.
The notice dated February 6, 2023, read in part “The hearing will be on Monday, March 27, 2023, from 9:30 am,” reads a court notice dated February 6, 2023.
The East African court of justice has already constituted a five-judge bench for the hearing on the appeal of the Kenyan Supreme Court ruling on his impeachment.
The five-judge bench includes Justice Gacuko Leonard. Justice Yohane Masara, Justice Charles Nyawello, Justice Richard Muhumuza and Justice Richard Wabwire.
The former embattled Nairobi Governor filed an application at East African Court of Justice in a bid to suspend implementation of the Supreme Court decision that upheld his impeachment.
In the case where Attorney General is the respondent, in that case, Mike Sonko insists that the decision of the Supreme Court was unjust.
He said the Presiding Judge at the High court who rendered the decision was then currently facing a disciplinary tribunal over his removal as a result of receiving bribes and influencing the decision that resulted in his removal from office.
Sonko wants the EAC court to suspend the execution of the decision by the Supreme Court, the highest in the country.
Part of the complaint before the tribunal, Sonko now says that justice Chitembwe was biased and mischievous in the manner in which he handled his impeachment case.
"The determination of the proceedings before the tribunal will have a bearing on the challenged judgment of the high court culminating in this appeal," Sonko said.
