The High Court will now decide Maxine Wahome's fate after a magistrate’s court ordered the termination of the investigation into her partner Assad Khan's death.

He issued the instructions in response to a plea from defence counsel Steve Kimathi and Anderson Musangi that Maxine be brought before Ochoi for further direction in the police investigations.

On Tuesday, the DCI is expected to accompany Maxine to Mathari Mental Hospital for evaluation to establish whether she is mentally fit to face trial for murder.

Gikui Gichuhi, Assistant Director of the DPP, requested that Maxine be escorted for a mental evaluation before entering a plea to the murder accusation leveled against her on Wednesday.

The judge granted the request after alerting Maxine about the charge filed by the DPP against her on March 7.

Gikui denied the defense lawyers' request to release the suspect on bond pending official charges.

Kimathi and Musangi agreed to present her for a mental evaluation and plea-taking if she is released on bond.

The judge, however, agreed with the prosecution that Maxine's position had changed and that she is now facing a capital charge, which carries a mandatory death sentence or life imprisonment if convicted.

Judge Mutende cancelled the lower court's Sh100,000 cash bail and ordered her to remain in the custody of DCI Kilimani till Wednesday.
