After claims of a dramatic raid by elite police officers at the home of former interior cabinet secretary Fred Matiangi on Wednesday night who attempted to arrest him on undisclosed charges, Fred Matiangi has moved to court to seek anticipatory bail.
Matangi through his lawyers lead by Danstan Omari has said that his life is under threat of arrest and his rights are being violated and he is fearing an arbitrary arrest
This coming even after inspector general of police Japheth Koome denied claims of any police officer deployed to arrest Matiangi, allegations that ethics and anti corruption commission EACC CEO Twalib Mbarak has refuted claims that the anti-corruption agency is involved over the alleged raid.
On Wednesday 9th Februay night Dunstan Omari had claimed that a battery of more than 200 lawyers had pitched camp at Karen home to prevent his arrest saying it was unconstitutional, questioning what grounds the cs was being arrested .
According to chapter 4 article 29 of the Kenyan constitution an anticipatory bail is bail pending arrest, provided the applicant demonstrates that his or her right to liberty is likely to be compromised or breached unlawfully by an organ of the state that is supposed to protect his right
