The high court has disregarded the former police sergeant Ahmed Rashid’s application that seeks to stop his plea taking. In a case, Rashid had taken issue with his prosecution for the murder of Jamal Mohamed and Mohamed Dahir in Eastleigh on March 31, 2017, arguing that they were robbers killed during a robbery incident. The two were crime suspects in Eastleigh and its environs.
Justice Kanyi Kimondo did not impinge on the independence of the directorate of Public Prosecution who approved the murder charges leveled against Ahmed in November last year. The court has however questioned as to why the former police officer was not summoned to take his statement of inquiry by IPOA.
The shooting incident took place at Eastleigh in Nairobi in broad daylight in front of a gathered crowd.
In January, the high court ordered Ahmed to surrender any nearby DCI offices pending investigations. Upon surrender, Ahmed was taken to Nairobi and booked at Capital hill police station and thereafter taken for mental assessment at Mathare mental police station.
On Wednesday, a section of the public took to the streets at the Milimani law courts following the prosecution of Ahmed Rashid. They later dispersed without causing any form of chaos.
Plea-taking has been set for March 22 before Justice Diana Mochache.
