A Kakamega-based businessman, Robert Malenya Lutta, has initiated legal proceedings against the controversial MP, Peter Salasya, by filing a case in the small claims court.
The dispute centers around a KSH 500,000 debt that Mr. Lutta had extended to the Mumias East MP in December 2022.
Through his legal representative, Edwin Wafula, Mr. Lutta asserts that he had loaned the amount to MP Salasya in good faith, with an agreement for it to be repaid within two months.
The transaction took place on December 13, 2022, when Mr. Malenya made a direct transfer to MP Salasya's personal account at the KCB Mumias Branch.
However, according to court documents, the lawmaker has allegedly failed to fulfil his promise and has not repaid the amount despite repeated reminders.
In response to this situation, the complainant is seeking the intervention of the court to compel Salasya to repay the loan along with accrued interest and cover the legal costs associated with the case.
Mr. Lutta is also prepared to utilize the Civil Procedure Act (Section 38), which permits the imprisonment of debt defaulters, should the MP be found guilty of failing to repay the debt.
It's worth noting that, as per his recent social media updates, MP Peter Salasya is currently reported to be residing in South Africa.
This legal action brings to light a notable case of alleged financial discrepancy between a businessman and a sitting Member of Parliament.
The small claims court will now play a pivotal role in addressing this matter and determining whether MP Salasya is liable for the loan.
